Altercation leads to shooting outside the Golden Rail

A Town of Newburgh man is in police custody following a Friday-night shooting outside the Golden Rail Ale House in the Town of Newburgh.

Town of Newburgh Police responded to the tavern on Friday at approximately 11:30 p.m. for the report of an altercation. Upon arrival, police found a 36 year-old man lying in the parking lot, with a wound to his leg that was bleeding profusely. While police were administering first aid, it was learned that the man had been shot during an altercation with another bar patron.

Through interviews, it was learned that the shooting victim had been inside the bar and had a verbal argument with a female patron. Another male, later identified as Michael Taback, 40, of the Town of Newburgh who was with the woman, reportedly confronted the victim. Taback was later identified as an off-duty Tuxedo Park police officer.

After  the brief verbal argument, the three left the bar and eventually resumed their argument in the parking lot. Police said the confrontation turned physical, with Taback striking the victim on the head several times with a pistol and later firing one round from the pistol that struck the victim in the leg. Police said Taback and the woman got into a vehicle and left the bar.

Police later located Taback in the vicinity and recovered the weapon that is believed to have been used in the vicinity. Taback, the woman and the victim were all take to a local hospital, where Taback and the woman were released a short time later.

Police arrested Taback, charging him with one account of First Degree Assault. He was arraigned before New Windsor Town Justice Noreen Calderin where bail was set at $25,000 cash or $50,000 bond. He was then turned over to the Orange County Sheriff’s Dept.
