Companies seek exemption in New Windsor

Since New Windsor’s temporary moratorium on development was first finalized, it has brought pushback from companies and support from residents of the town. Various entities have submitted requests for administrative relief from the moratorium.

Diversified Properties and its affiliate, DP Stonegate, LLC, are hoping to build a multi-family development on a parcel of land off of Little Britain Road. The property is known as “the stonegate property.”

“We believe that based upon the moratorium as written, we’re legally exempt from it,” said John Cappello, attorney for Diversified and DP. “Based upon the record of the proceedings that we have had actually and constructed rights to proceed on the action.”
Prior to the new town board taking office, Cappello said that it’s believed Diversified and DP would have obtained final approval for the project.

“We believe that the applicant stood ready to obtain its approval, prior to this new board taking office, and would have obtained that approval but for the actions of certain people to cancel meetings for no defined reason other than a request to frustrate my client’s due process rights to present and pursue an application,” said Cappello.

“It’s just unjust,” said Cappello about the temporary halt on the project.

The project is controversial because of the impact it could have on sewage, water, and traffic. In the Town of New Windsor, these issues are especially prominent and led to the development moratorium.

“You are not concerned about the New Windsor taxpayers,” said Supervisor George Meyers. “You are concerned about your project as you rightfully should be, but don’t come and sell it to us as if you have a great concern for the Town of New Windsor.”

The board later received and filed the notice of claim for Diversified Properties, LLC & DP Stonegate, LLC v. Town of New Windsor Town Board, et al.

The public hearing lasted nearly two hours.

The board later voted to not approve Dr. Jonathan Fugo’s application for administrative relief. The board also received and filed an application for administrative relief from Empire Properties, LLC. The public hearing for the application will be held on July 1 at 7 p.m.

The board also received and filed a Change.org petition against the development of the Stonegate property. The petition had 327 signatures.
