Lloyd approves Village project

Last week the Lloyd Planning Board approved the site plan for a senior living project known as the Village in the Hudson Valley. The project was previously granted a zoning change to a Planned Residential Retirement District [PRRD] by the Town Board and consists of an Assisted Living Facility and 197 independent living cottages. It is located on the western side of Route 9W, opposite the Bridgeview Shopping Plaza.

The Planning Board voted on two resolutions, the first was a lot line adjustment that passed by a vote of 5 to 2. Voting yes were Carl DiLorenzo, Scott McCarthy, Franco Zani, William Meltzer and Lambros Violaris and voting no were Sal Cuciti and Gerald Marion. Board member Charley Long was absent.

A second resolution, which also resulted in the same 5-2 vote tally, laid out the requirements and phasing on the construction of the project. It stated that the, “phasing plan for the PRRD and associated conditions [is] intended to ensure that both principal uses as approved are undertaken by the Applicant [Marc Sanderson] and that the traffic light proposed for the intersection of Mayer Drive and NYS Route 9W and the sidewalks along Route 9W are installed.” The resolution noted that the Applicant, “seeks to proceed at its own risk” with the construction of some of the independent living units subject to future Site Plan review and approvals and conditions for each of phases B-F of the PRRD.

Some of the approved plans specified the requirements for grading, utilities, erosion and sediment control, landscaping, site lighting, a plan for the emergency access road and storm water control, to name a few of the itemized conditions on the approval.

The resolution also notes that the developer needs to receive Ulster County Health Department approval for all proposed sewer and water improvements; proof of recording of the approved lot line adjustment map with the Ulster County Clerk’s Office; submission of an Affordable Housing plan that demonstrates how this PRRD project will comply with housing regulations in the town code; provide a maintenance program for all buildings and an energy conservation plan. It also notes that the developer must pay all recreation, escrow and other required fees to the town.

The resolution also requires that the developer obtain a NYS Department of Health license for the Assisted Living Facility and the independent living units for this PRRD approval.

To move through the various construction phases, the developer has to show proof of satisfaction of any technical comments from the town’s engineer; proof of a permit from the NYS Department of Transportation that a traffic signal is to be installed at the intersection of Mayer Drive and Route 9W; a signed amended developer’s agreement between the developer and the Town of Lloyd for the PRRD; proof of a recording in the Ulster County Clerk’s Office of any necessary utility or other easements for the PRRD, including an acceptable conservation easement; and proof that the developer has submitted documentation to the County Clerk of deed restrictions for the parcels in the PRRD concerning eligibility requirement for residents.

The resolution stipulates out in great detail the actual construction and issuance of zoning and building permits from the Building Department, along with comments from the town’s engineer on how to proceed through the phases.

Construction must take place on weekdays between 7 a.m. to 5 p.m. and be adequately screened from neighboring properties to control dust at all times, per the Building Code Enforcement Officer.
