ZONING BOARD OF APPEALS MEETING NOTICE

NOTICE OF HEARING

NOTICE is hereby given that, pursuant to Section 267a (1) of the Town Law, State of New York and Section 23515.2 (B) of the Zoning Law of the Town of Montgomery, a Public Hearing will be held by the Zoning Board of Appeals of the Town of Montgomery, New York on Tuesday the 20th day of December, 2022 at 7:00 P.M., in the Town Hall, 110 Bracken Road, Town of Montgomery, New York, to act upon the following appeal:

APPLICATION OF KCE NY 2, LLC for area variances from Section 2357.3 of the Town Zoning Code for the maximum height allowed for necessary utility infrastructure associated with the proposed Tier 2 Battery Energy Storage System, including the following equipment and proposed heights: dead-end H-frame structure with lightning masts on top, approximately 55 feet; two (2) static poles in the proposed substation, approximately 55 feet; Gen-Tie line poles, varying in height from 50 feet to 67 feet. All proposed infrastructure is shown on the site plan on file with the Zoning Board of Appeals office.

PREMISES LOCATED at Tax Map Parcel No. 26157.221, which is located north of Route 17K between the intersection with Stone Castle Road and Browns Road in the Town of Montgomery.

TAKE NOTICE that the applicant should appear at the hearing and all persons interested in any way may appear and be heard by the Board.

PLEASE TAKE FURTHER NOTICE that any resident of the Town of Montgomery is entitled to be heard upon said application at the public hearing. Copies of the application may be inspected at the Town Government Center located at 110 Bracken Road, Montgomery, New York 12549, during normal business hours. Written comments are strongly encouraged to be submitted prior to or at the public hearing.
