First, I would like to thank everyone who reached out with there support and also their own travails with Town of Newburgh Code Compliance. A special thank you to the Libertarian Party and Mr. Geraci for their kind support also.
Last Friday I stopped by Town Court to make sure of the date that Judge Martini would make his decision on my Motion to Dismiss. It was supposed to be sometime by the end of July. The clerk looked it up and told me my next appearance was September 9th. I asked her if Judge Martini had issued his ruling and she told me to talk to my attorney. I asked the clerk to please look at the file and tell me if there was a decision. “Ah, yes, your file – hold on I have something for you”. The clerk went to a file cabinet where another clerk was waiting and returned with a file. “You have an outstanding ticket” she said. Ticket? “It’s a little old” she replied. What for? “An unregistered boat.” Someone did a thorough search of my records. The ticket was 26 years old! I paid the $75 and called my attorney who didn’t know anything about a September 9th date.
The September date seems to indicate that the Town will be taking this case to trial.
Code Compliance Supervisor Gerald Canfield and the Consulting Engineer for the Planning Board, David Hines, have both filed sworn affidavits with the Court. I intend to call both Mr. Canfield and Mr. Hines to the stand to defend what I believe are their clearly false sworn statements material to this case.
I also plan to present documentary evidence to the Town Board at their next meeting of an incident that happened over a decade ago.. I thought it was kind of old to dredge up. These documents show clear malfeasance of certain Code Compliance employees in a separate incident in 2012.
This current affair is just part of an ongoing abuse by some of the power entrusted to Town employees and consultants by the Town of Newburgh through their elected officials.
An unregistered boat ticket from the last century? Really? They have done their research, emptied their quiver and poked a Bear!
