The Town of Montgomery Industrial Development Agency will hold a public hearing on Wednesday, Nov. 9 at 1 p.m. at Town Hall, located at 110 Bracken Rd to discuss the construction of a 169 megawatt battery energy storage facility.

The proposition comes from New York Limited Liability Company KCE NY 2, LLC, who is applying for 8.03 acres of space at 364 Browns Rd for the said project. According to the public hearing notice published on Oct. 6 by Montgomery Industrial Development Agency Chairperson Jeffrey D. Crist, the facility will be a 169-megawatt battery energy storage containing battery energy containers, an inverter, transform containers and a project substation.

KCE NY 2, LLC is also asking for financial assistance which may include tax exemption from “...certain sales and use taxes, real property taxes, real estate transfer taxes and mortgage recording taxes…”

If the project is accepted, the Town of Montgomery Industrial Development Agency will have to provide taxation exemptions concerning the new facility. As stated in the notice, “If any portion of the Financial Assistance to be granted by the Agency with respect to the Project is not consistent with the Agency’s uniform tax exemption policy, the Agency will follow the procedures for deviation from such policy set forth in Section 874(4) of the Act prior to granting such portion of the Financial Assistance.”

KCE NY 2, LLC and the Town of Montgomery have already agreed to a community benefit agreement of $1,461,293.73.
