Unsafe structure determination

The Town of New Windsor held a hearing for the determination of an unsafe structure at as 111 Cedar Avenue. The determination from the town would be that if the demolition does not occur by the property owner, then the town would oversee the demolition.

According Attorney Marie Nicholson, an asbestos test has been completed and the company is in the process of pulling permits for demolition of the site through Fannie Mae.

As soon as permits are obtained, the demolition company would move forward with the clearing of the building. 111 Cedar Avenue was a two-story property that was subject to a rapid structural fire that killed the occupant of the home.

“The one problem that we are having is the utility companies will not shut off service to the property on the word of my client, because we don’t own the property,” said Nicholson. “So we’re hoping that the town would assist us in getting utilities shut down.”

Back in August, the town board had voted to approve the Town Code Enforcement Officer and Town Engineer to inspect the property and prepare a report on the building. The report would identify the current condition of the building, the building’s safety and overall habitability.
